1. Introductory Provisions

1.1 Before using the Portal, every User is required to carefully read these "Operational Terms for the Use of the Personal Transport Portal of České dráhy, a.s." Using this Portal means that the User has read and agrees to these terms. If the User does not agree with these terms, they are not authorized to use the Portal.

1.2 The following terms used in these Terms, capitalized for emphasis, have the following meanings:

• “ČD” means České dráhy, a.s., headquartered at Nábřeží Ludvíka Svobody 12, Prague 1, 110 15, Czech Republic, Company ID: 70994226, registered in the Commercial Register kept by the Municipal Court in Prague, Section B, File 8039.
• “Portal” means the collection of websites, applications, and services located at the internet address www.cd.cz, m.cd.cz, and the mobile application My Train.
• “User” means any entity accessing the Portal’s pages, using these pages, or utilizing applications or services of the Portal.
• “Registration” means the registration of selected personal data of the User in the Portal system. Registration is required by legal obligations for providing certain applications and services of the Portal or by ČD's targeted intention to allow access to certain parts or services of the Portal only for registered Users.
• “Terms” means these Operational Terms for the Use of the Personal Transport Portal of České dráhy, a.s.

1.3 The owner of the Portal is ČD. The content of the Portal, its graphic design, texts, data files, and design are protected by copyright and rights of the authors of individual components under Act No. 121/2000 Coll., Copyright Act, as amended. Unless otherwise provided by the Copyright Act, any use of the Portal content is only possible based on prior written licensing for such use.

2. Use of the Portal and Registration of User Data

2.1 The Portal is primarily intended for quickly obtaining information, an overview of services, offers, the mission, and activities of ČD by the User. Additionally, it is intended for publishing information for ČD clients and other purposes that may arise from contractual agreements between the client and ČD.

2.2 Any use of the Portal or information obtained from the Portal, or any part thereof, other than as stated in section 2.1, especially further use in the form of distribution, copying, further processing, modification, or creation of additional reproductions, is prohibited.

2.3 By using the Portal, the User confirms that they have read and accepted the Terms and will use the Portal only in accordance with these Terms and applicable general legal regulations.

2.4 When using the Portal, the User must act in such a way as to prevent damage to ČD or third parties.

2.5 The provision of certain applications and services of the Portal or access to certain parts of the Portal may be conditioned upon the User's Registration through the Portal. Users will be notified of the need for Registration in the relevant part of the Portal or associated application or service. Registration of data by the User is voluntary.

2.6 Key information for User access to those parts of the Portal requiring Registration includes an email address and password.

2.7 By using the Portal, the User agrees to the following:

• Not to interfere with the content or graphic processing of the Portal or its security.
• Not to send unsolicited email messages or messages with harmful content to the Portal, nor disseminate such messages via the Portal.
• Not to attempt unauthorized access to the Portal, any of its parts, or accounts of other Users.
• To provide only truthful information about their identity and contact details during Registration and to update these details as necessary.
• Not to share key access details for the Portal (see 2.6) with others.

2.8 Registration is performed by the User via the Portal. During Registration, the User enters the following mandatory registration details:

• First Name (mandatory)
• Last Name (mandatory)
• Email Address (mandatory)
• Password (mandatory)
• Phone Number
• Occupation (e.g., student, employee)
• Confirmation of understanding the Privacy Protection Terms (mandatory)
• Consent to receive commercial communications

2.9 These basic details may be supplemented with additional information depending on the User's choice of services and applications on the Portal:

• Card Number
• Registered In Card Number with EP
• Validity of In Card with EP
• Company Name (mandatory)
• Company Address (Street + Number, City, Postal Code) (mandatory)
• Company Phone
• Calendar Days (Mon - Sun) or Weekly Information on Closures (mandatory)
• Region (mandatory) for closure information
• Railway Line According to the Timetable for Closure Information
• Route Details (from, to, via, time, departure/arrival) for closure information
• Favorite Regions for Closure Information

2.10 Users may terminate their Registration at any time via the Portal.

2.11 ČD reserves the right to terminate User Registration if the User's use of the Portal violates these Terms or applicable legal regulations. Additionally, ČD may terminate the Registration of a User who has not logged into the Portal for over 12 months. ČD is not obligated to inform the User of termination for these reasons.

3. Portal Security Policy

3.1 The User is fully responsible for protecting the computer used to visit the Portal, including software and data stored on it, as well as actions and steps taken concerning the Portal.

3.2 ČD makes reasonable efforts to ensure the security of data transmitted via data networks to or from the Portal. However, ČD accepts no liability for the interception or misuse of data during transmission to or from the Portal beyond the technical capabilities of the systems supporting the Portal.

3.3 If a User discovers misuse of their login credentials, they must inform ČD without delay.

3.4 If the User consents to receive commercial communications, such communications will be sent to their email address.

3.5 Consent to receive commercial communications can be withdrawn anytime through the Portal.

4. Liability of ČD

4.1 The Portal is publicly accessible via the Internet, and ČD is not responsible for its availability on the User's devices.

4.2 The Portal offers various applications and services depending on ČD's needs and intentions. The User has no legal right to access these applications and services. ČD reserves the right to temporarily or permanently suspend selected applications and services of the Portal or the Portal itself without compensation or prior notice.

4.3 ČD strives to ensure that the Portal contains current and accurate information. However, due to third-party involvement, technical dependencies, and update timing, ČD cannot fully guarantee the information's currency or accuracy. Users should not rely solely on the Portal as their exclusive information source and should compare and verify the information with other sources.

4.4 ČD is not responsible for any content on the Portal uploaded by third parties without ČD's knowledge or in violation of these Terms or applicable laws. Such content may be removed by ČD at any time.

4.5 ČD is not responsible for the content, availability, or security of third-party websites linked to the Portal or any obligations or relationships arising between Users and third parties.

4.6 ČD is not liable for any damages incurred by the User while using the Portal.

5. Cookies

5.1 To ensure the proper functioning of the Portal's pages, small data files called cookies are placed on the User's device, as is standard practice for most websites if enabled in the User's browser settings. Cookies help remember User activities and preferences for a certain period, so they do not have to be re-entered on subsequent visits or when navigating between pages.

“GDPR” means Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

“ZEK” means Act No. 127/2005 Coll., on Electronic Communications and Amendment of Certain Related Acts (Electronic Communications Act), as amended.

5.2 Various types of cookies are used on the Portal’s pages, some placed directly by this website and others by third-party tools utilized by ČD. Some cookies may be used without User consent, while others require it.

5.3 If the User does not want to use cookies or wants their browser to notify them when cookies are sent, they can configure their browser accordingly.

5.4 The User acknowledges that setting their browser to not use cookies may result in the Portal’s pages not working as intended.

6. Final Provisions

6.1 These Terms become effective on the day of publication on the Portal. ČD reserves the right to update these Terms at any time. Updates to these Terms will be published on the Portal pages.
